WiggleBop Terms of Use

These Terms of Use ("Terms") are an agreement between you and Clever Loop Labs LLC ("Clever Loop Labs," "we," "us"), the company that provides the WiggleBop app ("WiggleBop" or the "App"). Please read them carefully.

1. Who Agrees to These Terms

WiggleBop is meant to be set up and managed by a parent or legal guardian who is at least 18 years old. By creating a parent PIN, tapping "I agree," or using the App, you confirm that you are that parent or guardian, that you accept these Terms for yourself and on behalf of any child who uses the App on your device, and that you have read the WiggleBop Privacy Policy. If you do not agree, do not use the App.

2. Who WiggleBop Is For

WiggleBop's activities are designed for children ages 6 to 12, used under the supervision of a parent, guardian or other responsible adult. You are responsible for deciding whether WiggleBop and each activity is suitable for your child.

3. Physical Activity and Safety

WiggleBop encourages children to move, for example by hopping, marching, dancing and doing animal walks. Physical activity carries a risk of falls, collisions and other injuries. By using WiggleBop, you agree that:

• An adult should supervise children while they use WiggleBop's movement activities.
• You will make sure the activity area is clear of furniture, toys, pets, sharp corners, stairs, glass and other hazards, and that the floor is not slippery.
• The phone or tablet should be placed securely where it will not fall and where children will not run into it.
• Children should stop right away if they feel pain, dizziness, faintness, shortness of breath or discomfort, and should rest and drink water as needed.
• You should check with your child's doctor before using WiggleBop if your child has a medical condition, injury, or any reason to limit physical activity.
• WiggleBop's prompts are suggestions for play. They are not medical, fitness, therapy or health advice, and WiggleBop does not monitor your child's health or safety.

You participate, and you allow your child to participate, at your own risk, to the fullest extent permitted by law.

4. Screen-Time Controls Are Not Guaranteed

WiggleBop helps you manage screen time by spending earned time while selected apps are on screen and by returning to WiggleBop or the home screen when time runs out. These controls depend on Android settings that you turn on, such as the Accessibility service, and they have limits. For example, they can be turned off in Android settings, the App can be uninstalled or its data cleared, some apps, windows or background audio may not be detected, and timing may be delayed or inaccurate. WiggleBop is a helper, not a security or parental-monitoring product. You remain responsible for supervising your child's device use and the content your child can reach.

5. Camera Movement Detection

If you turn the camera option on, WiggleBop uses the camera to notice whether there is movement in view. This is approximate. It can miss movement or count movement that is not the activity, and it does not identify who is moving or which movement was done. You can turn the camera off and confirm activities by hand instead.

6. Coins, Rewards and Virtual Items

Coins, levels, badges, stickers, mystery prizes, shop items and other rewards in WiggleBop are part of the game. They have no cash or monetary value, cannot be bought with real money, sold, transferred or exchanged, and are not property. They are stored only on your device and may be lost if the App's data is cleared, the App is uninstalled, or the device is lost or replaced. We may change or rebalance rewards in future versions.

7. Purchases and Subscriptions

WiggleBop may offer paid features or subscriptions in the future through Google Play. If we do, purchases will be handled by Google Play under Google's terms, prices and renewal details will be shown before you buy, and refunds and cancellations will follow Google Play's policies and applicable law. Parent-only purchase screens will be placed in the parent area of the App.

8. Your License to Use WiggleBop

We give you a personal, non-exclusive, non-transferable, revocable license to install and use WiggleBop on devices you own or control, for your family's personal, non-commercial use, in line with these Terms and the Google Play terms that apply to apps you download. You may not copy, modify, sell, rent, reverse engineer (except where the law allows it), or redistribute the App, or remove any notices from it. WiggleBop includes open-source software that is licensed under its own terms; see "Open-Source Licenses" in the parent area. Clever Loop Labs LLC keeps all rights to WiggleBop, including its name, design, artwork, sounds and code, except for that open-source software.

9. Other Apps and Content

WiggleBop lets you choose other apps your child can use with earned time. We do not make, control or review those apps or their content, and we are not responsible for them. Their own terms and privacy policies apply.

10. Privacy

The WiggleBop Privacy Policy explains what information the App accesses and how it is used. It is part of these Terms.

11. Disclaimer of Warranties

To the fullest extent permitted by law, WiggleBop is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that WiggleBop will be uninterrupted, error-free, accurate, or that it will work on every device.

12. Limitation of Liability

To the fullest extent permitted by law, Clever Loop Labs LLC and its owners, members, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising out of or related to WiggleBop or these Terms. To the fullest extent permitted by law, our total liability for any claim related to WiggleBop is limited to the greater of the amount you paid us for WiggleBop in the 12 months before the claim or US $50. Some places do not allow certain limits on liability, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Changes to WiggleBop and These Terms

We may update WiggleBop and these Terms from time to time. If we make a material change to these Terms, we will update the effective date and let you know in the App, for example by asking you to review and accept the new Terms in the parent area. Continuing to use WiggleBop after an update means you accept the updated Terms.

14. Ending Use

You can stop using WiggleBop at any time by uninstalling it. We may stop offering WiggleBop or any feature at any time.

15. Governing Law

These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law rules, except where the law of the place you live requires otherwise.
